Rooftop Compliance & Violation Notices

Following our community-wide drone footage collected on June 2, 2026, the Association conducted a comprehensive audit of rooftop deck usage and maintenance across the property. All original cure deadlines have now passed.

Please Note: This is not a new policy, but rather a formal process to consistently enforce existing policies and governing documents across the property to protect building structures and General Common Elements.

Enforcement Update: All Timelines Have Expired

Please be advised that all original cure periods for rooftop violations have officially expired. Daily fines are now actively being applied to accounts that have not submitted photographic proof of resolution.

To cease enforcement: You must simply submit a picture verifying that the item has been cured.
Need an extension? You must request one by responding directly to your violation notification email for the Board to consider.

Violation Categories & Active Fines

The following parameters define the required actions and active penalties for non-compliance based on the Board's adopted enforcement framework:

Unapproved Storage Storing items, debris, mats, or hazardous materials (e.g., propane tanks) on the bare roof membrane or unauthorized areas. All stored items, debris, mats, and hazardous materials must be removed from the bare roof membrane and stored securely inside the unit. $5 / day
Improper Use of Area Active-use items such as furniture, grills, or workout equipment placed on non-deck roof areas. All active-use items must be relocated to the designated deck surface or removed. The bare structural roof membrane must remain clear at all times. $25 / day
Improper Maintenance Failure to maintain elements like artificial turf in good order, creating tripping hazards or drainage issues. Artificial turf must be repaired, replaced, or removed to ensure it does not create a tripping hazard or impede the building's drainage system. $25 / day
Unapproved Alteration Unauthorized changes to the exterior or common elements, including fence modifications or privacy screen installations. Restore the area to its original condition. Alternatively, an ARC application may be submitted for retroactive review (approval is not guaranteed). $25 / day

How to Resolve Your Notice

Proof of Compliance Required

To officially clear a violation and halt any accruing daily fines, you must simply submit a picture showing that the item has been cured. Upload your compliance photos directly to the violation notice in the Owner Portal.

Owner Rights & Enforcement Remedies

  • Right to a Hearing: You have the right to request a hearing before the Board of Directors to contest any violation. Written requests must be submitted within 30 days of the date on your notice.
  • Military Service Notification: If you or your spouse is currently serving in the Texas National Guard, another state's National Guard, or a reserve component of the U.S. Armed Forces, please notify management in writing immediately.
  • HOA Remedies: Per Declaration Art. 11, failure to cure by the deadline may result in further enforcement, including suspension of Common Element privileges, legal action, or Association Self-Help rights to remove violations at the owner's expense.

Note on Inspection Scope

  • Phase 3 Defect Repairs: Wall boards, doors, and fences were not evaluated for violations during this rooftop audit, as those elements will be addressed or impacted during our upcoming Phase 3 Defect Repairs. Most fence maintenance can be delayed until Phase 3 is complete.
  • Roof Membranes: While roof membranes were not evaluated for structural integrity during this visual audit, owners are strongly encouraged to have their membranes regularly inspected by a licensed professional roofer.

We are thrilled to report that almost all exterior repairs have been completed! Thank you to everyone who stepped up to preserve the aesthetic standard of The Vine.

For the single remaining unit, please remember that fines of $5 per day are actively being applied. If you have secured a contractor, the Board can stop the fining and hold your deadline open.

How to Stop Fines & Extend

To halt enforcement actions, you must reply to your notice with a copy of a signed contract or proposal from your vendor that clearly shows:

  • The full scope of work (matching the outstanding items on your inspection report).
  • A specific scheduled start date for the repairs.
